Bob Bergdahl, Father Of Prisoner Of War Army Sgt. Bowe Bergdahl, Speaks At Rolling Thunder Motorcycle Rally

WASHINGTON -- The father of a U.S. soldier who was taken prisoner in Afghanistan thanked the motorcycle riders of Rolling Thunder on Sunday for raising awareness of missing-in-action troops and prisoners of war.

At the annual Rolling Thunder rally on the National Mall, Bob Bergdahl promised his son: "You will come home. We will not leave you behind."

Army Sgt. Bowe Bergdahl, 26, of Hailey, Idaho, was taken prisoner in Afghanistan nearly three years ago. He is the subject of a proposed prisoner swap in which the Obama administration would allow the transfer of five Taliban prisoners long held at the U.S. military prison at Guantanamo Bay, Cuba.

Bergdahl said he couldn't be happier with the government's efforts to return his son.

"This is a complicated issue and it's going to demand all aspects of American government. And we need joint cooperation, we need every level, every agency and every dimension of American government to cooperate and pay attention," he said. "We're on a mission to get our son home and we're not going to stop until we accomplish that."

Motorcyclists attending the ceremony wore yellow wristbands with Bergdahl's name and the date he went missing on them. Many also wore the traditional biker gear of leather vests and riding boots, even though temperatures reached the 90s.

Hundreds of thousands of bikers, including military veterans and non-veterans, gathered in the nation's capital this weekend for the Rolling Thunder rally.

Auto Finance Could Be DOJ's Next Focus in SCRA Enforcement

Auto Lending News Reports:

The down payment assistance for auto financing arena could be the next target of the Department of Justice in order to enforce the Servicemembers Civil Relief Act after the recent announcement that two towing companies have settled an action alleging violations of the SCRA.

According to firm Ballard Spahr, if the DOJ targets down payment assistance for auto financing in future SCRA enforcement actions, it could target actions like:

- Failing to reduce a servicemember?s interest rate as required;
- Repossessing property purchased by a servicemember under an installment contract without a court order;
- Failing to comply with SCRA requirements related to a lease termination requested by a servicemember.

Indeed the Consumer Financial Protection Bureau? through its Office of Servicemember Affairs? has identified the SCRA as a focus for its own examinations and enforcement actions which could be a sign of whats to come.?

In 2009, after an amended complaint against two towing companies was filed in federal court in Virginia, the DOJ alleged that the two companies towed the cars of servicemembers who were on active duty and sold the cars at auction without obtaining a court order. The DOJ claimed the sales violated the SCRA provision prohibiting someone who holds a storage lien on property of a servicemember from enforcing the lien while the servicemember is on active duty, and for 90 days thereafter, without a court order.

From jdsupra.com: The DOJ?s consent order provides relief to 26 servicemembers whose cars were alleged to have been towed and sold by the defendants in violation of the SCRA. It requires the defendants to pay $75,000 in damages and request that all major credit bureaus remove any negative entries resulting from information reported by the defendants.

Ballard Spahr points out that the firm has counseled auto finance companies on the implications of the consent order on their operations as well as on the likelihood of related DOJ enforcement actions.

Aereo wins partial victory in broadcasters' suit

NEW YORK (AP) ? Aereo, a startup that takes live TV broadcasts and sends them to mobile devices in New York for a monthly fee, has won a partial victory in court over the media companies that are suing it.

U.S. District Court Judge Alison Nathan in New York dismissed one of three claims made by the broadcast companies, which include ABC, CBS, NBC and others in a ruling released Monday.

Nathan dismissed the claim of unfair competition, saying it was pre-empted by the Copyright Act.

Two claims of copyright infringement remain. A hearing on a preliminary injunction begins May 30.

The broadcasters have argued that Aereo is copying and retransmitting their programming unlawfully. Aereo contends that by assigning miniature antennas to each of its users, it is providing legal access to free over-the-air broadcasts.

An Aereo spokeswoman declined to comment.

A spokesman for News Corp.'s Fox said the judge's dismissal of the unfair competition was on "technical grounds" and didn't judge the merit of the copyright claim.

"We look forward to our day in court to prove that Aereo's unauthorized streaming of our content constitutes copyright infringement," the spokesman said in a statement.

The case is being closely watched because of the precedent it could set. Broadcasters owned by The Walt Disney Co., CBS Corp. and Comcast Corp. have deals to collect hundreds of millions of dollars annually from cable and satellite TV providers for the right to retransmit their signals to subscribers.

Such signals are also available freely using an antenna, but most TV households pay for service through a provider. If Aereo's service is found not to infringe on broadcasters' copyrights, it could upend a system that has created a profitable new revenue stream for media companies.

After the social network's stock fizzled on Friday in its long-awaited debut, its stock fell 11 percent on Monday, even as the rest of the stock market rallied.

The downward spiral has left some people sitting on big losses, and others scratching their heads. After all, nothing fundamental has changed at?Facebook?in the days since the much-hyped company came to the stock market ??Facebook?still has more than 900 million users, its 28-year-old founder Mark Zuckerberg controls the company, and it is still one of the few profitable Internet companies to go public.

Facebook's?IPO ?like Netscape's in 1995 and Google's in 2004? was billed as a milestone moment. Netscape's offering ushered in the era of the Internet browser. The company's stock more than doubled in its first day of trading. Google's IPO heralded the age of search. It posted an 18 percent gain in its stock market debut.?Facebook?was supposed to offer proof that social media is a viable business and more than a passing fad.

But investors don't seem convinced.?Facebook's?stock closed Monday at $34.03, down 11 percent from Friday's closing price of $38.23. The investment banks that arranged?Facebook's?offering set a price of $38 on Thursday. Although many investors had hoped for a big first-day pop,?Facebook's?stock opened Friday at $42.05 and fluctuated between $45 and $38 throughout the day.

Facebook?stock was down 7 percent to $31.65 in early trading Tuesday.

For a host of reasons,?Facebook's?falling share price shouldn't have been a surprise.

?Its IPO occurred the same week that the markets posted their worse performance so far in 2012. The Standard & Poor's 500 index fell 4 percent.

?Meanwhile, Europe was trying to avert financial disaster.

?At the same time, the American public's love affair with the stock market continued to wane. People have yanked over $400 billion from U.S. stock mutual funds since 2008.

?Banks are being cautious too. All this is happening in the backdrop where banks are under pressure from regulators to become more conservative after the financial crisis. "Regulators want banks to take less risk," said Larry Tabb, founder and CEO of Tabb Group, a markets research firm. "To support a $100 billion offering can be challenging in this environment."

?Investors were also spooked by the trading glitches at the Nasdaq stock market on Friday. Some people weren't sure if their trades had been executed and trading of the stock was delayed by a half hour.

"It was like trying to get a jumbo jet to take off in turbulent weather," said Kathleen Shelton Smith, principal of Renaissance Capital, IPO research. "It's going to be a bumpy ride."

With all of these factors in place on the day of?Facebook's?IPO, some people may wonder why?Facebook'sstock didn't do worse.

The answer is:?Facebook?had some help. On Friday,?Facebook?only got as low as pennies above the offering price of $38 per share but never fell below. The banks that arranged the IPO, the deals underwriters such as Morgan Stanley and others, put in enough "buy" orders at $38 to keep the price from dropping below that level. It's a customary gesture from underwriters to support the company they helped bring to market, explains Jay Ritter, a finance professor at the University of Florida. It's a way to save face and show that the company and the bankers gauged an appropriate level of demand from investors and valued the company correctly.

Volcanic island of Santorini displaying signs of unrest

ScienceDaily (May 22, 2012) ? Archived data from the Envisat satellite show that the volcanic island of Santorini has recently displayed signs of unrest. Even after the end of its mission, Envisat information continues to be exploited for the long-term monitoring of volcanoes.

Santorini is a picturesque Greek island in the south Aegean Sea and the most active volcanic centre in the South Aegean Volcanic Arc.

The island is the site of one of history's largest volcanic eruptions, about 3600 years ago. The geological record over the past million years reveals an extensive history of eruptions, with the most recent occurring in 1950.

But despite being dormant for over half a century, satellites have detected slight movements.

These and other findings were presented at the International Forum on Satellite Earth Observation for Geohazard Risk Management, currently under way in Santorini itself.

Organised by ESA in partnership with the Group on Earth Observations (GEO), the forum is focusing on the science and applications of satellite Earth observation to support the management of risks associated with geophysical hazards.

Seismic activity in Santorini, such as the underground movement of magma, from January 2011 to May 22 has caused ground deformation that was detected by Envisat's radar.

Even from an orbit about 800 km above the ground, deformations of a few centimetres can be detected by satellite radars.

When two or more radar images of the same area are combined, changes in signal reflections between them can be measured. This technique called Differential Interferometric Synthetic Aperture Radar -- or DInSAR -- has become a useful tool for detecting ground deformation.

Envisat shows that the northeastern part of Santorini's Nea Kameni volcano experienced an uplift of about 5 cm in 2011, while other areas of the volcano rose some 3-4 cm.

"Monitoring to detect any change of the status of the volcano presents a further step towards the understanding of physical processes related to volcanic eruptions that can lead to natural disasters," said Prof. Issaak Parcharidis from the Department of Geography at the Harokopio University of Athens.

During the first months of this year, Santorini saw a drop in the speed of deformation, accompanied by a reduction in seismic activity.

"After evaluation of local seismic activity, deformation and physicochemical changes, [we] concluded that during the last months the volcano presents a very limited activity, much lower than that of 2011," said Prof. Kosmas Stylianidis, Head of the Special Scientific Committee for the Monitoring of Santorini Volcano.

"The Committee, in its monthly report of April to the government, advises the application of no restrictive measure concerning the mobility of population."

Contact with Envisat was lost on 8 April, but ten years of archived data from the mission will continue to be used by scientists for monitoring volcanoes and many other studies.

The continuation of observation from coming satellite missions, such as the family of Sentinels under Europe's Global Monitoring for Environment and Security programme, is crucial for ensuring data flow to scientists and operational users dealing with hazard and risk assessment.

The offspring of Zurich?s Hiltl restaurant (Europe?s oldest veg restaurant), Tibits is the perfect spot to suit all tastes; there really is something for everyone on offer. I?ve never had a bad evening out here, it?s a good central location, and the staff are some of the nicest folks in town. The food is laid out buffet style on what they?ve termed the food boat, where you help yourself to the dishes which take your fancy (there are also sandwiches, soups, and pastries at the counter). It works on a pay by weight system, which is admittedly something I doubted initially because I thought it?d cost more, but in the end I realised I don?t pay more for a filling meal at Tibits than I would anywhere else in that part of the city. The menu is seasonal, so expect some dishes to shift (popular items often stay), and items are clearly marked vegetarian, vegan, with gluten, and with nuts.

Once a month Tibits hosts London Vegan drinks, organised by Sean of Fat Gay Vegan, and it?s one of the best nights out a wine-loving vegan could hope for. It?s every third Thursday of the month from 18:30 ?til closing, held in the basement of the restaurant. The chefs always lay out a big spread of vegan items at drinks too, including curries and stews, salads, puddings, and more. Two of the favourites I constantly hear mentioned by friends on the night are the sticky toffee pudding and the bean salad. Personally I am mostly focused on the Sauvignon Blanc and onion rings.

Should you wish to find me I will be the inebriated yank in the corner, dressed like an inappropriate five year old. If there are onion rings on your plate and you walk by, expect me to borrow one.

Spot the onion rings

The story behind the onion rings, which, if you?ve ever been to Tibits with me you?ll know is a bit of an obsession, is more than a little nonsensical. It all started when I learned of their vegan-ness (I hadn?t previously given them a glance because there?s often egg in the batter). Deep fry is one of my favourite food groups so, as you can imagine and understand, the moment was rather an epiphany.

Then there was the night they weren?t on the menu.

Tragedy. Commence Onion-Ring-Gate.

See, I?d been having so much fun at vegan drinks (seriously, make an effort to come sometime) that a few of us returned one Friday night for a mid-month gathering (and now I find any old excuse to go). Letters were written, complaints lodged.?On serviettes.

?Where are the onion rings? Stop oppressing us,? they read, and were hand delivered to the kitchen by one of my now favourite staff members.

The joke with those lucky enough to be working on that fated night only progressed as the evening went on, with phone calls made to the kitchen and suggestions to perhaps accidentally falling through the door to have a word with the chef. Finally chef came upstairs for a chat and sealed himself as another of my staff favourites (who at the last vegan drinks kindly gave me a food boat tour of all the restaurant?s new Spring dishes?? such a nice bloke).

Incidentally I may or may not have been consuming wine that evening.

Much to my amusement I?ve not been forgotten by those guys, and onion rings still come up frequently in conversation whenever I?m at Tibits and they?re unlucky enough to be working that shift. A massive thanks to Tibits staff for entertaining (babysitting?) me on these occasions. You guys are awesome.

Final Thoughts

What more can I say? I love this place. Somehow the restaurant manages to present itself as ideal for both varied occasions and diners, and on so many levels to boot. From business lunches and social gatherings (large or small) to dates (well this is an assumption ? I never actually learned to date, and the thought makes me squirm #SerialLongTermRelationshipper #HashtagsOnBlogPosts #EnoughAboutMeNow), Tibits is suitable for a range of occasions. Likewise it?s a suitable spot for an array of diners, catering to vegans, vegetarians, and those with gluten and/or nut allergies, with all items clearly marked for suitability (moreover I?ve yet to hear any omnivore register a complaint about the place).

So if you?re ever in central, pop down Regent Street to find this gem of a spot. A bottle (or two) of the Sauvignon Blanc and a plate of onion rings will have you sorted for the rest of the evening.

T-Mobile Prism

The T-Mobile Prism ?could've been a contender?if it was still the beginning of 2011, that is. Aside from a mediocre camera, there isn't anything terribly wrong with the Prism. It has pretty good call quality and a nice design that feels comfortable to hold. But its specs are better suited to an entry-level smartphone?released well over a year ago. You can do much better than the Prism now, for not a lot more money.

Design and Call Quality
Made by Huawei (though you'd only know that by peeking under the battery cover), the Prism measures 4.6 by 2.4 by 0.5 inches (HWD) and weighs 4.4 ounces. It's comfortable to hold and a very good size if you don't like huge phones. The back panel is made entirely of dark gray rubberized plastic, with a shiny gray plastic ring surrounding the all-glass display on the front. The 3.5-inch capacitive touch LCD sports a standard 480-by-320-pixel resolution. It's not going to wow you, but it looks fine and gets the job done. The on-screen keyboard is large enough and I was able to type on it without an issue.

The Prism is a quad-band EDGE (850/900/1800/1900 MHz) and dual-band HSPA 7.2 (1700/2100 MHz) device with 802.11b/g Wi-Fi. It also supports T-Mobile's UMA-based Wi-Fi calling, which is a good way to save some money on your phone plan and a nice fallback in areas where network coverage is lacking. The Prism can be used as a mobile hotspot with the appropriate data plan.

Reception is average, and voice quality is pretty good. Voices sound nice and full in the phone's earpiece, though maximum volume is still a bit low. Calls made with the phone sound clear, if a touch computerized, with good noise cancellation. Calls also sounded fine through a?Jawbone Era?Bluetooth headset ($129, 4.5 stars) and voice dialing worked well over Bluetooth without training. The speakerphone sounds fine, but is far too low to use outdoors. Wi-Fi-based calls sounded good as well. Battery life was average, at 6 hours and 1 minute of talk time.

Android and Apps
The Prism runs Android 2.3.6 (Gingerbread) with some very minor customizations from Huawei. There's no word on an update to Android 4.0 (Ice Cream Sandwich), but it isn't likely. There are five customizable home screens you can swipe between that come preloaded with a number of apps and widgets. There's also some non-deletable bloatware, about on par with that you'll find on most other Android devices nowadays. You get free Google Maps Navigation for voice-enabled, turn-by-turn directions, along with a built-in FM radio. The phone should also work with many of the 400,000+ third-party apps in the Google Play store.

Unfortunately, all of this is powered by a thoroughly out-of-date 600MHz Qualcomm MSM7627 processor. The Prism turned in some of the lowest benchmark scores we've seen in quite some time, and you can really feel that while using the phone. Even paging between home screens or scrolling through the app menu can feel stilted. You can count this phone out for gaming, since even basic tasks can be slow.

Multimedia, Camera, and Conclusions
The Prism comes with 149MB of free internal memory along with a preinstalled 2GB microSD card; my 32 and 64GB SanDisk cards worked fine as well. There's a standard-size 3.5mm headphone jack on top of the phone, and music sounded fine through both wired earbuds as well as?Altec Lansing Backbeat?Bluetooth headphones ($99.99, 3.5 stars). The phone was able to play AAC, MP3, OGG, and WAV test files, but not FLAC or WMA. Video support wasn't as strong. The phone was only able to play back H.264 and MP4 test files at resolutions up to 800-by-480, but at that resolution, they were somewhat stuttered.

The 3.2-megapixel auto-focus camera lacks a flash or autofocus. Shutter speeds are slow at 1.2 seconds. Photos snapped lack detail, and colors look a bit muddy. The camera also records 800-by-480-pixel video at a shaky 19 frames per second outdoors and 16 frames per second inside.

The T-Mobile Prism isn't a terrible phone; there just isn't much of a reason to buy it. For only $10 more, the Samsung Exhibit II 4G?($29.99, 3.5 stars) gets you a faster 1GHz processor, and a nicer 3.7-inch 800-by-480-pixel display. It also runs on T-Mobile's much faster HSPA+ 21 network. Meanwhile, $50 will get you either the T-Mobile myTouch?($49.99, 3.5 stars) or the T-Mobile myTouch Q?($49.99, 3.5 stars). The myTouch features a nice 3.8-inch AMOLED display and a 1GHz processor, while the myTouch Q sports the same 1GHz processor and a slide-out QWERTY keyboard. Each of those phones will offer a much smoother experience than the Prism. Or for something completely different, the Nokia Lumia 710?($39.99, 3.5 stars) is running the easy-to-use Windows 7.5 "Mango" operating system, is powered by a fast 1.4GHz processor, and runs on T-Mobile's faster HSPA+ 14.4 network.

Thursday?s unexpected development in the Saints? bounty scandal came from the decision of linebacker Jonathan Vilma to sue Commissioner Roger Goodell in a Louisiana federal court.? As mentioned in the first of what surely will be more than 10 and less than 1,000 items on the legal action, Goodell?s initial line of defense will arise under the labor deal.

Specifically, he?ll file a motion to dismiss the lawsuit, citing Article 43, which sets forth the procedures for ?non-injury grievances.?

Here?s what it says (free one-year PFT subscription to anyone who reads it all):? ?Any dispute (hereinafter referred to as a ?grievance?) arising after the execution of this Agreement and involving the interpretation of, application of, or compliance with, any provision of this Agreement, the NFL Player Contract, the Practice Squad Player Contract, or any applicable provision of the NFL Constitution and Bylaws or NFL Rules pertaining to the terms and conditions of employment of NFL players, will be resolved exclusively in accordance with the procedure set forth in this Article, except wherever another method of dispute resolution is set forth elsewhere in this Agreement.?

The lawsuit claims that Goodell lied about Vilma in multiple ways via written and spoken communications regarding Vilma?s alleged role in the bounty program.? Goodell undoubtedly will argue that he was acting in his capacity as NFL Commissioner, and that all statements about the bounty investigation were made under the provisions of the NFL Constitution and Bylaws regarding the integrity of the game.? Thus, the argument will be that Vilma is required to pursue ?any dispute? regarding those comments to the procedures set forth in the Collective Bargaining Agreement, which will shield the NFL from the public nature of a civil action ? and ultimately from the whims of a Louisiana jury.

It?s a common argument, identical to the defense the NFL already has raised to the concussion lawsuits brought by former players.? Labor agreements routinely establish in-house mechanisms for resolving disputes, and the Federal Arbitration Act gives judges a mechanism for washing their hands of lawsuits that otherwise are covered by the terms of a CBA.

That said, Vilma likely will claim that Goodell forfeited the protection of the CBA by making statements that were beyond the confines of the application of the NFL Constitution and Bylaws.? The argument likely will be that Goodell should have merely suspended Vilma without public commentary or accusation, saying nothing about what Vilma allegedly did to merit the suspension.

If that?s the argument, it could have some merit.? Without question, the NFL has chosen to release certain information publicly in the hopes that it will shape the perception of media and fans regarding the Saints? bounty program.? The question for the court to decide will be whether those activities pull the situation away from the four corners of the CBA.

Goodell will have other defenses.? Vilma, for example, is a public figure, which means that Vilma will have to prove that Goodell acted with malice.? To prove the existence of malice in this context, Vilma will have to show that Goodell knew the statements were false, or that he acted with reckless disregard as to whether the statements were true or false.? Vilma?s argument, if the case progresses to that point, surely will be that Goodell jumped to irrational conclusions as to Vilma in order to advance his safety agenda.

Shortleaf pine-hardwood ecosystem restoration following insect outbreak

OTTO, NC--Research by USDA Forest Service Southern Research Station (SRS) scientists shows that the impacts of recent outbreaks of southern pine beetle further degraded shortleaf pine-hardwood forest ecosystems in the southern Appalachian region. The authors suggest that cutting and burning these sites reduces heavy fuel loads, improves soil nutrient status, and opens the canopy for restoration of these shortleaf pine communities.

In an article published in the June issue of journal Forest Ecology and Management, research ecologist Katherine Elliott and fellow scientists from the SRS Coweeta Hydrologic Laboratory examine the effects of three treatments to restore shortleaf pine-hardwood forests in areas where southern pine beetle attacks have killed most of the overstory pines.

Historically, frequent fire maintained the pine-hardwood ecosystems of the southern Appalachians as open grassy savannas with widely spaced oaks and shortleaf pines, a grassy understory, and relatively clear midstory. The interactions of past land use, fire exclusion, drought, and southern pine beetle outbreaks have severely impacted these ecosystems.

"Over the past century, these ecosystems have been on a trajectory of increased loss of pines in the overstory, lack of regeneration of both pines and oaks, loss of ground layer plants, and the expansion of the evergreen shrub mountain laurel in the midstory," says Elliott. "The latest outbreak of southern pine beetle, a native insect, killed more overstory pines, further damaging the ecosystem while adding fuel for fire."

For the study, the researchers selected eight 12 to 15-acre study sites in pine-hardwood ecosystems where a large number of the pines had been killed by southern pine beetle. They tested the effects of burning only, cutting and burning on sites with droughty soils, and cutting and burning on sites with medium soil moisture. Two years after the treatments, they reported increased soil nutrient availability, greater herbaceous plant cover and diversity, and more native bluestem grasses.

Unfortunately, they found only a few pine seedlings in the understory after the treatments. "In our study, poor pine regeneration may have been due to drought, poor seed production, and hardwood competition in the understory," says Elliott. "Poor seed production was not unexpected, since southern pine beetles killed almost all of the overstory pines before the treatments."

The researchers found that though oak regeneration increased on all the burned sites, other hardwood species increased as well. The researchers suggest that without further intervention, oaks will not succeed into the overstory due to competition from faster growing hardwoods.

This study showed that cutting followed by prescribed fire can reduce fuel loads, increase soil nutrient availability, open the canopy by reducing trees in the overstory, and stimulate vegetative growth. These cut-and-burn treatments have positioned these degraded ecosystems on a restoration trajectory.

"Further silvicultural treatments are needed to fully restore these sites to shortleaf pine/bluestem communities," says Elliott. "Additional follow-up treatments could include planting pine seedlings, using thinning or herbicides to reduce competition from faster growing red maple and sassafras sprouts and shrubs, and repeated burning to maintain open woodland for native grass and other plant cover."

"Land managers need information on treatment options that will reduce the heavy fuel from dead and dying trees, and they need information on how to most effectively restore these forests," says Elliott. "We will continue to work with land managers on applying and refining these treatments in their efforts to fully restore shortleaf pine/native bluestem grass ecosystems."

"Without the partnership and support from the National Forests of North Carolina, Tennessee, and Georgia this research would not be possible or as relevant," she adds. "For this study, the Ocoee Ranger District, Cherokee National Forest was responsible for implementing the treatments and they worked closely with the researchers to make it all happen." In return, researchers provide the information to the National Forest partners and others by onsite tours and workshops.

This research was partially funded by the Joint Fire Science Program, which supports scientific research on wildland fires and distributes results to help policymakers, fire managers and practitioners make sound decisions.
